Welcome to the servicePath (“servicePath”, “the Company”, “we”, “us” and/or “our”) website (the “Site”). This Site is operated by servicePath and has been created to provide information about our company, our capabilities, our cloud-based configure, price and quote (CPQ) platform (the “Platform) and complementary consulting/technical services (“Services”). This Privacy Policy explains how we collect, use, disclose and protect information that applies to our Platform, Services and Site. For capitalised terms that are not defined in this Privacy Policy, please refer to our Terms of Use.

1. Information you provide us directly
servicePath collects Personal Information from you when you voluntarily provide it to us. Whenever the Company collects Personal Information we make an effort to provide a link to this Privacy Policy. The Company collects Personal Information when you contact us with inquiries, respond to our surveys, download content from our Site, express interest in obtaining additional information about our Platform, register to use our Platform and/or fill out certain forms on our Site.
In those cases mentioned above, servicePath requires you to provide the Company with personal contact information, such as name, company name, address, phone number, and email address (“Basic Contact Information”). When purchasing access to the Platform, buying Services or registering for an event, servicePath may also require you to provide the Company with financial qualification and billing information, such as billing name and address, credit card number, and the number of employees within the organization that will be using the Platform (“Billing Information”). servicePath may also ask you to provide additional information, such as company annual revenues, number of employees, industry, sales team structure, product mix, solution offerings or technology partners (“Optional Information”). When applying for a job with the Company, servicePath may require you to submit additional personal information as well as a resume or curriculum vitae (“Applicant Information”). Basic Contact Information, Billing Information, Applicant Information, Optional Information and any other information you submit to servicePath to or through the Services are referred to collectively as “Personal Data.”
As you navigate the Company’s Web sites, servicePath may also collect information through the use of commonly-used information-gathering tools, such as cookies and Web beacons (“Website Navigational Information”). Website Navigational Information includes standard information from your Web browser (such as browser type and browser language), your Internet Protocol (“IP”) address, and the actions you take on the Company’s Websites (such as the Web pages viewed and the links clicked). For additional information about the collection of Website Navigational Information by servicePath please refer to section 4 below.
Through our “import users” feature option, we may also collect information such as the name, company name, address, phone number or email address of employees that you choose to share with us. When you provide us with personal information about your employees, we will only use this information for the specific reason for which it is provided, such as granting them access to the Platform.
By voluntarily providing us with Personal Data, you are consenting to our use of it in accordance with this Privacy Policy. You acknowledge and agree that such Personal Information may be transferred from your current location to the offices and servers of servicePath and the authorized third-parties of servicePath.

When you purchase servicePath Services or become a user of our CPQ Platform, we will ask you to provide billing information and more detailed contact information.
When you register for or attend servicePath events, we will ask you to provide basic contact information; information on your participation in, as well as interest in, the event; and possibly billing information.
We use common Internet technologies, such as cookies and Web Beacons to keep track of interactions you have with our Website, emails and social media posts.
We collect personal information to help improve our Platform, Services and Website.

You may unlink your third-party account from the Platform by adjusting your settings on the third-party service.

We may directly collect analytics data, or use third-party analytics tools to help us measure traffic and usage trends for the Platform and Site. These tools collect information sent by your browser or mobile device, including the pages you visit and other information. We collect and use this analytics information in aggregate form such that it cannot reasonably be manipulated to identify any particular individual user.

4. Website Navigational Information
servicePath uses commonly-used information-gathering tools, such as cookies and Web Beacons, to collect information as you navigate the Company’s Websites (“Website Navigational Information”). We use these cookies or similar technologies to analyze trends, administer Websites and our Platform, track users’ movements around our Websites and Platform, serve targeted advertisements and gather demographic information about our users.
Cookies
When you visit our Site or use our Platform, we may send one or more cookies (a small file downloaded and accessed by your web browser). By themselves, cookies do not contain any personal information about you. Cookies just help recognize your web browser. Only when you choose to identify yourself to servicePath, by responding to a promotional offer, becoming a user of our Platform, or filling out a Web form (like our “Contact Us” form or a webinar registration form), or have previously identified yourself to swervicePath, you are anonymous to the Company.
Cookies may convey information to us about how you use our Platform and Site. For example: the pages you view, the links you click and other actions you take and allow us or our business partners to track your usage of our Platform and Site over time. You can reset your web browser to refuse all cookies or to indicate when a cookie is being sent. However, some features of our Platform and Site may not function properly if the ability to accept cookies is disabled.
Required Cookies. These types of cookies enable you to navigate the Company’s Sites and use its features, such as accessing secure areas of the Site and using the Platform. If you have chosen to identify yourself to servicePath, the Company may place on your browser cookies containing an encrypted, unique identifier. These cookies allow the Company to uniquely identify you when you are logged into the Site and Platform and to process your online requests. Since Required Cookies are essential to the operation of the Site and Platform, there is no option to opt out of these cookies.
Functionality Cookies. These types of cookies allow the Company’s Sites and Platform to remember information you have entered or choices you make (such as your username, language, or your region) and provide enhanced, personalized features. These cookies can also be used to remember changes you have made to text size, fonts and other parts of web pages that you can customize. Functional cookies may also be used to improve how the Company’s Sites and Platform function and perform, to enhance and customize your interactions with the Company, and to help us provide you with more relevant messages, including marketing communications. These cookies collect information about how you use our Sites and Platform, including which pages visitors go to most often.
Advertising Cookies. servicePath sometimes uses cookies delivered by third parties to show you ads for the Company’s products and services that we think may interest you on any devices you may use and to track the performance of Company advertisements. For example, in these cases, cookies remember information such as which browsers have visited the Company’s Sites. The information provided to third parties does not include personal information, but this information may be re-associated with personal information after the Company receives it. servicePath also contracts with third-party advertising networks that collect IP addresses and other information from Web Beacons (see below) on the Company’s Sites and Platform, from emails, and on third-party Web sites. Ad networks follow your online activities over time and across different sites or other online services by collecting Website Navigational Information through automated means, including through the use of cookies. These technologies may recognize you across the different devices you use, such as a desktop or laptop computer, smartphone or tablet. Third parties use this information to provide advertisements about products and services tailored to your interests. You may see these advertisements on other websites or mobile applications on any of your devices. This process also helps us manage and track the effectiveness of our marketing efforts. Third parties, with whom the Company partners to provide certain features on our Sites or to display advertising based upon your Web browsing activity, use Flash cookies to collect and store information. Flash cookies are different from browser cookies because of the amount of, type of, and how data is stored.
4. Website Navigational Information
We may send cookies to your web browser to help you use our Platform and navigate our Website. We use cookies to customize content, serve targeted advertisements and gather demographic information about visitors to our Website and users of our Platform. You can adjust your cookie settings in your browser.
5. Web Beacons
servicePath uses Web Beacons alone or in conjunction with cookies to compile information about usage of the Company’s Sites and Platform as well as interaction with emails from the Company. Web Beacons are clear electronic images that can recognize certain types of information on your computer, such as cookies, when you viewed a particular website or service tied to the Web Beacon, and a description of a website or service tied to the Web Beacon. For example, servicePath may place Web Beacons in marketing emails that notify the Company when you click on a link in the email that directs you to one of the Company’s Sites. servicePath uses Web Beacons to operate and improve the Company’s Sites, Platform and email communications.
5. Web Beacons
We use advanced techniques (clear gifs, also called Web Beacons) to determine the interactions people have with our Site and our emails. We may use Web Beacons alone or with Cookies. We may also use Web Beacons to track the performance of our marketing emails. Web Beacons help us improve our Sites, our Platform and our electronic communication.
6. Log file information
Log file information is automatically reported by your browser or mobile device each time you access our Platform and Site. When you use either, our servers automatically record certain log file information. These server logs may include anonymous information such as your web request, Internet Protocol (“IP”) address, Internet Service Provider and/or mobile carrier, browser type, referring pages/URLs, exit pages/URLs, number of clicks, link interactions, domain names, landing page activity, pages viewed, files opened, your searches, your operating system, system configuration information and date/times of your usage. This information is used to analyze overall trends, to help us improve our Sites and Platform, to track and aggregate non-personal information and to service the Site and Platform.

Whenever you load a page from our Platform or Site, your browser sends us information about itself and your interactions. That information get stored on our servers.
7. Social Media
The Company’s Sites may use social media features, such as the Facebook “like” button (“Social Media Features”). These features may collect your IP address and which page you are visiting on the Company’s Site, and may set a cookie to enable the feature to function properly. You may be given the option by such Social Media Features to post information about your activities on the Company’s Web site to a profile page of yours that is provided by a third party social media network in order to share with others within your network. Social Media Features are either hosted by a third party or hosted directly on the Company’s Site. Your interactions with these features are governed by the privacy policy of the company providing the relevant Social Media Features.
7. Social Media and Single Sign-on
Our Website may use certain social media features that allow you to like, share and post information to your social media profile. These features may collect information about you and the page you visited.

servicePath may allow you to log in to certain of our Sites and Platform using sign-in services such as Facebook Connect. These services will authenticate your identity and provide you the option to share certain personal information with us such as your name and email address to pre-populate our sign-up form.

9. Device identifiers
When you access our Platform or Site on a mobile device, we may access, collect, monitor and/or remotely store one or more device identifiers such as a universally unique identifier (“UUID”). A device identifier may be related to the device hardware, operating system or loaded software. A device identifier may convey information to us about how you navigate our Platform or Site. A device identifier may remain persistent on your device, to help you log in faster and enhance your navigation of our Platform and Site. Some features may not function properly if use or availability of device identifiers is blocked or disabled.

We may store a device identifier on your mobile device to help with navigation and log-in. We use device identifiers from mobile devices to help improve our Platform.
10. Location data
When you access the Platform or Site on a mobile device, we may access, collect, monitor and/or remotely store “location data,” which may include GPS coordinates or similar information regarding the location of your mobile device. Location data may convey to us information about how you browse and use the Service. Some features of the Platform and Site, particularly location-based services, may not function properly if use or availability of location data is impaired or disabled.

11. Advertisements
We may also share certain information such as your location, browser and cookie data and other data relating to your use of our Platform and Site with our business partners to deliver advertisements (“ads”) that may be of interest to you. servicePath may allow third-party ad servers or ad networks to serve advertisements on the Platform or Site. These third-party ad servers or ad networks use technology to send, directly to your browser or mobile device, the ads and ad links that appear on the Platform or Site, and will automatically receive your IP address when they do so. They may also use other technologies (such as cookies, JavaScript, device identifiers, location data, and clear gifs, see above) to compile information about your browser’s or device’s visits and usage patterns on the Platform or Site, and to measure the effectiveness of their ads and to personalize the advertising content. servicePath does not sell, rent, or share the information we collect directly from you or about you from third parties with these third-party ad servers or ad networks for such parties’ own marketing purposes.
Please note that an advertiser may ask servicePath to show an ad to a certain audience of Users (for example, based on demographics or other interests). In that situation, servicePath determines the target audience and servicePath serves the advertising to that audience and only provides anonymous aggregated data to the advertiser. If you respond to such an ad, the advertiser or ad server may conclude that you fit the description of the audience they are trying to reach.
This servicePath Privacy Policy does not apply to, and we cannot control the activities of, third-party advertisers. Please consult the respective privacy policies of such advertisers or contact such advertisers for more information.
11. Advertisements
If we have to have ads in our Platform or Site, we may have to use your Personal Information we have stored in order to show you appropriate ads.
12. Commercial and marketing communications
We use the information we collect or receive to communicate directly with you. We may send you emails, direct messages, texts or other forms of electronic correspondence containing newsletters, promotions and special offers. If you do not want to receive such correspondence, you have the ability to opt out or change your preferences.
We also use your information to send you Platform-related communications. For example: account verifications, service reminders, updates to features of the Platform, technical and security notification. You may not opt out of Platform-related communications.
12. Commercial and marketing communications
In order to grow our business, we send out communications that contain content that we hope you find interesting and useful. These commercial messages may be related to our Platform or Services that you do not already use. You can easily opt out of receiving these types of messages from us. We promise to stop when you do. We will, however, continue to send you important notifications regarding the Platform for as long as you are a customer/user.
13. Do Not Track
Some web browsers – including Internet Explorer, Firefox, and Safari – offer a “do not track” or “DNT” option that relies on a technology known as a DNT header, which sends a signal to websites visited by the user about the user’s browser DNT preference setting. servicePath does not currently respond to browsers’ DNT signals with respect to the Company’s Sites. This is partly because there is no industry standard way of interpreting DNT requests. The Company will continue to monitor and review the developments in this area.
13. Do Not Track
At this time our Website and Platform do not process “Do Not Track” requests from your web browser.
14. Public forums and testimonials
servicePath may provide blogs, chat rooms or public forums on the Company’s Sites. Any personal information you choose to submit in such a forum may be read, collected, or used by others who visit these forums, and may be used to send you unsolicited messages. servicePath is not responsible for the personal information you choose to submit in these forums.
servicePath discloses publicly the names of certain Customer Organizations and Testimonials on the Company’s Sites that contain information such as Customer names and titles. servicePath obtains the consent of each Customer prior to posting any information or testimonials.
14. Public forums and testimonials
Any information you share on our blogs, chat rooms or other public forums may be read and used by others. We are not responsible for the personal information you choose to disclose on these public forums. servicePath does list the names of customers and customer organizations on its Website. We obtain consent from each customer prior to posting any information or testimonial.
15. Use of information we collect
servicePath will not sell or rent to any third party any of the Personal Information or data that you provide to us. If you provide Personal Information for a certain reason, we may use the Personal Data in connection with the reason for which it was provided. For example, if you contact us by email, we will use the Personal Information you provide to answer your question or resolve your problem. Also, if you provide Personal Information in order to obtain access to the Platform, we will use your Personal Information to provide you with access to the Platform and to monitor your use of it.
We use or may use cookies, log file, device identifiers, location data and clear gifs information to: (a) remember information so that you will not have to re-enter it during your visit or the next time you visit the Platform or Site; (b) provide custom, personalized content and information; (c) monitor the effectiveness and usability of our Platform; (d) monitor aggregate metrics such as total number of visitors, traffic, and demographic patterns; (e) diagnose or fix technology problems; (f) help you efficiently access your information after you sign in; (g) provide advertising to your browser or device, and (h) automatically update the servicePath application on your devices.
servicePath may share Data about Site Visitors and Users with the Company’s contracted service providers so that these service providers can provide services on our behalf. These service providers are authorized to use your personal information only as necessary to provide the requested services to us. Without limiting the foregoing, servicePath may also share Data about SIte Visitors and User with the Company’s service providers to ensure the quality of information provided, and with third–party social networking and media Websites, such as Facebook, for marketing and advertising on those Websites.
servicePath and its subsidiaries and affiliates may also use your Personal Information and other personally non-identifiable information collected through the Platform and Site to help us improve the content, functionality, navigation and overall user experience of the Platform and Site. servicePath, its subsidiaries, and its affiliates may use this information to contact you in the future to tell you about services we believe will be of interest to you. If we do so, each communication we send you will contain instructions on how to opt-out of receiving future communications. In addition, if at any time you wish not to receive any future communications or you wish to have your name deleted from our mailing lists, please contact us at contact@servicepath.co
From time to time, servicePath may partner with other companies to jointly offer products, services, or programs (such as webinars or downloadble content). If you purchase, specifically express interest in, or register for a jointly–offered product, service, or program from or through servicePath, the Company may share Data about you collected in connection with your purchase or expression of interest with our partner(s). servicePath does not control our business partners’ use of the Data about servicePath Users that we collect, and their use of the information will be in accordance with their own privacy policies. If you do not wish for your information to be shared in this manner, you may opt not to purchase or specifically express interest in a jointly offered product or service.
If servicePath intends on using any Personal Information in any manner that is not consistent with this Privacy Policy, you will be informed of such anticipated use prior to or at the time at which the Personal Information is collected.
15. Use of information we collect
We won’t sell or rent your Personal Information to third-parties outside servicePath and its group companies (parent, subsidiaries and affiliates) without your consent except where necessary to provide you access to or use of the Platform.
In order to maintain our Platform and make your user experience as seamless as possible, we use some of the aforementioned information.
16. Disclosure of your Personal Information
servicePath is not in the business of collecting and selling Personal Information. We consider this information a vital and important component in establishing a long-term relationship with you. There are, however, certain circumstances in which we may share your Personal Information with certain third-parties without notice to you as set forth below.
Legal Requirements
servicePath will disclose your Personal Information where required to do so by law or subpoena or if we reasonably believe that such action is necessary to (a) comply with the law and the reasonable requests of law enforcement; (b) to enforce our Terms of Use or to protect the security or integrity of our Platform, Services or Site; and/or (c) to exercise or protect the rights, property, or personal safety of servicePath, our Users or others.
Business Transfers
In the event of a sale, merger, reorganization, dissolution or similar event of servicePath, Personal Information may be part of the transferred assets.
Related Companies
servicePath may disclose your Personal Information with our parent organization, subsidiaries and affiliates for purposes consistent with this Privacy Policy.
Agents, Consultants and Related Third-Parties
servicePath sometimes hires other companies or individuals to perform certain business related functions. When we use another company to perform these functions, we only provide them with the Personal Information that they need to perform their specific function or provide the specific service.
16. Disclosure of your Personal Information
We don’t sell your Personal Information. Our partners, affiliates and contractors may have limited access to your Personal Information but only in order to do their job. If we sell the company, Personal Information may be included in the transfer. If it is legally required for us to share your Personal Information then we fully intend to obey the law.
17. Exclusions
This Privacy Policy shall not apply to any unsolicited information you provide to servicePath through the Platform, Site or through any other means. This includes, but is not limited to, information posted to any public areas of the Platform or Site, such as bulletin boards, support forums, or blog posts (collectively, “Public Areas”), any ideas for new products or modifications to existing products, and other unsolicited submissions (collectively, “Unsolicited Information”). All Unsolicited Information shall be deemed to be non-confidential and servicePath shall be free to reproduce, use, disclose, and distribute such Unsolicited Information to others without limitation or attribution.
If you are invited to join a servicePath team account, and you accept the invitation, you are agreeing that certain of your Personal Information will be shared with the team account holder and other team members. In particular, the team account holder will have access to your name, email address, avatar (if any) and task usage, and other team members will have access to your name, email address and avatar (if any). Any information you share via a team account or Third-Party Services you link to, will be available to all team members of the team account you have joined. You are solely responsible for any information you share via a team account, which is posted at your own risk.
This Privacy Policy applies only to the Platform and Site. Both may contain links to other third-party web sites not operated or controlled by servicePath. This Privacy Policy do not apply to these third-party web sites. The links from the Platform or Site do not imply that servicePath endorses or has reviewed the third-party web sites. Please review the privacy policies of these third-party web sites for more information.
17. Exclusions
This Privacy Policy only applies to Personal Information we collect. If you post information in a public place (support forums, blogs, social media platforms), this is considered public information. Thus it can be shared and reproduced freely. Similarly, if you join a servicePath team account, certain of your Personal Information may be available to the account holder and other team members with administrative access.
18. Correcting and updating your information
servicePath may retain your information for a period of time consistent with the original purpose of collection. For instance, we may retain your information during the time in which you have an account to use our Platform and for a reasonable period of time afterward. We also may retain your information during the period of time needed for servicePath to pursue our legitimate business interests, conduct audits, comply with our legal obligations, resolve disputes and enforce our agreements.
You may request to review, correct, delete or otherwise modify any of the Personal Information that you have previously provided to us through the Company’s Sites and Platform. If you have registered for an account with servicePath, you may update your user settings, profile, organization’s settings or event registration by logging into Site or Platform with your username and password and editing your settings or profile. To update your billing information, discontinue your account, and/or request return or deletion of your data associated with your account, please contact your account representative or the customer service team. For other requests to access, correct, modify or delete your Data, please go to the “Contact Us” section below. Requests to access, change, or delete your information will be addressed within a reasonable timeframe. If you are an employee of a servicePath customer, you may also wish to contact your company’s system administrator for assistance in correcting or updating your information.
18. Correcting and updating your information
If you are a User of our Platform, you can change and update your personal account information from within the Platform. If you are an employee of a customer of servicePath and you wish to change your information, please contact your system administrator for assistance.

19. Children
servicePath does not knowingly collect Personal Information from children under the age of 13. If you are under the age of 13, please do not submit any Personal Information through the Platform or Site. We encourage parents and legal guardians to monitor their children’s Internet usage and to help enforce our Privacy Policy by instructing their children never to provide Personal Information on the Platform or Site without their permission. If you have reason to believe that a child under the age of 13 has provided Personal Information to servicePath through the Platform or Site, please contact us, and we will endeavor to delete that information from our databases.
19. Children
You must be at least 13 years old to use servicePath. If you believe someone under the age of 13 has voluntarily provided Personal Information to servicePath, please contact us and we will endeavor to remove that information from our databases.
20. Information Storage
The Personal Information collected through the Platform and Site may be stored and processed in Canada or any other country in which servicePath or its subsidiaries, affiliates or parent maintains facilities. servicePath may transfer information that we collect about you, including Personal Information, to affiliated entities, or to other third parties across borders and from your country or jurisdiction to other countries or jurisdictions around the world. If you are located in the European Union or other regions with laws governing data collection and use that may differ from Canadian law, please note that we may transfer information, including personal information, to a country and jurisdiction that does not have the same data protection laws as your jurisdiction, and you consent to the transfer of information to Canada or any other country in which servicePath or its parent, subsidiaries, affiliates or service providers maintain facilities and the use and disclosure of information about you as described in this Privacy Policy.
20. Information Storage
servicePath uses computers all over the world. This means your information might be transferred to Canada, Europe, US, Australia, and anywhere else the Platform, Services or Site is operated.

servicePath cares about the security of your information, and uses commercially reasonable safeguards to protect Personal Information against loss, misuse, and unauthorized access, disclosure, alteration, or destruction. However, no Internet or email transmission is ever fully secure or error free. You are responsible for maintaining the secrecy of your unique password and account information, and for controlling access to your communications, particularly email, with servicePath at all times
21. Information Security
We take many steps to ensure your private information and account credentials are safe. To this end, if you find a security problem, contact us. Please note that emails and communications with us are not encrypted.
22. Changes to servicePath Privacy Policy
The Platform, Services, Site and our business may change from time to time. As a result, at times it may be necessary for servicePath to make changes to this Privacy Policy. We reserve the right to update or modify this Privacy Policy at any time and from time to time. If we do this, we will post the changes to this Privacy Policy on this page and will indicate at the top of this page the date these terms were last revised. We will also notify you, either through the Platform user interface, in an email notification or through other reasonable means. Please review this policy periodically, and especially before you provide any Personal Information. Any such changes will become effective no earlier than fifteen (15) days after they are posted, except that changes addressing new functions of the Platform or Site. Changes made for legal reasons will be effective immediately. This Privacy Policy was last updated on the date indicated above. Your continued use of the Platform or Services after the date any such changes become effective constitutes your acceptance of the new Privacy Policy.

If anything changes with our Privacy Policy, we will let you know at least 15 days in advance via this website or an email if you are already a servicePath user.
23. Jurisdiction
